Any capitalised terms used in these Conditions of Entry have the meaning given in the Schedule, unless stated otherwise.

  2. Entry into the giveaway promotion (competition) is deemed acceptance of these terms and conditions. If there is any inconsistency between these Terms and Conditions and anything else that refers to this competition, these Terms and Conditions will prevail.

  3. The Promoter is CRYPTOSPEND PTY LTD (ACN 630 245 813)

  4. Entrants must be 18 years of age or older as at the date of entry in order to be eligible to enter the competition.

  5. Entrants must be verified CryptoSpend users. To become a verified CryptoSpend user, entrants must download the CryptoSpend app, sign up, and get verified (complete KYC process). To verify identity, entrants can use their passport, drivers licence, etc. Once completed they will be able to enter into this giveaway competition.

  6. To enter, the entrant must spend at least $30 worth of crypto through the CryptoSpend Card and they will automatically go in the draw to win a prize. The more the entrant spends, the higher their chance of winning becomes. Stablecoins listed on the platform are also acceptable for spending to participate in this competition. AUD spending will not be counted.

  7. The Promotion commences on 21/11/23 Tuesday 12:00am AEDT until the End Date 30/11/23 Thursday 11:59pm AEDT ("Promotional Period"). Only valid and eligible entries will be accepted during the Promotional Period. Winners of the giveaway will be contacted before 7/12/23 Thursday 11:59pm AEDT.

  8. The Prize is five separate crypto giveaways gifted to five winners. The prize will be awarded to the person named in the entry and any entry that is made on behalf of an entrant or by a third party will be invalid. If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner.

  9. The Prize is $100 worth of Bitcoin awarded to each of the five giveaway winners.

  10. The $100 in BTC will be transferred directly to the giveaway winners' CryptoSpend Wallet.

  11. The Promoter reserves the right to request winners to provide proof of identity, proof of residency and/or proof of entry validity to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

  12. Entry for the competition and details of how to enter are shared on our verified Meta, Instagram, and X (Twitter) accounts (@cryptospend and @cryptospendau).

  13. The Promoter reserves the right to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions or Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but is not limited, to entrants and households using multiple CryptoSpend accounts or forms of identification.

  14. The time of entry will in each case be the time the online entry is received by the Promoter’s database, not at the time of transmission by the entrant.

  15. The Promoter accepts no responsibility for any late, lost or misdirected entries due to large technical disruptions, network congestion or for any other reason.

  16. The Promoter accepts no responsibility for any tax implications and the entrant must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize.

  17. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
